Who we are

Everlight Media Ltd provides customer-acquisition and performance-marketing services.
Acceptance of these terms
By accessing or using this website, you agree to these Terms of Use.
If you do not agree to these terms, you should not use the website.
These terms apply to use of the corporate Everlight website. Separate written terms may apply where Everlight agrees to provide services, run a Proof Test, deliver leads or other commercial outcomes, or enter into another business relationship with you.
Information on this website
The website provides general information about Everlight, its approach, capabilities and services.
Website content is provided for general business information and does not by itself constitute professional, legal, financial or other specialist advice.
Although we aim to keep website information accurate and up to date, we do not guarantee that every item of information will always be complete, current or free from error.
You should obtain appropriate professional advice where a decision requires it.
Proof Test applications
Businesses may use this website to apply to speak with Everlight about a Proof Test.
Submitting an application does not automatically mean Everlight has accepted an applicant as a client and does not by itself create a contract between the applicant and Everlight.
Every business Everlight takes on starts with a funded, controlled Proof Test within an agreed scope and spend cap.
The scope, objectives, responsibilities and commercial arrangements for a Proof Test will be agreed separately where Everlight and the business decide to proceed.
A funded Proof Test means Everlight funds the agreed initial test within the agreed scope and spend cap. It does not by itself determine the price or treatment of leads, appointments, customers or other commercial outcomes generated through the test.
Any charges that may apply to agreed qualifying outcomes, and any terms for continuing or scaling a campaign, will be communicated and agreed separately before the relevant commercial arrangement begins.
No guarantee of commercial results
Customer-acquisition and marketing performance can be affected by many factors outside Everlight’s control, including market conditions, competition, pricing, customer demand, the advertiser’s offer, sales performance and third-party advertising platforms.
Nothing on this website should be interpreted as a guarantee of a particular number of leads, appointments, customers, revenue, profit, return on advertising spend or other commercial result.
Where Everlight enters into a commercial agreement with a client, any specific commitments will be governed by the terms of that agreement.
Intellectual property
Unless otherwise stated, the content of this website, including its text, branding, graphics, designs and original website materials, is owned by or licensed to Everlight Media Ltd and is protected by applicable intellectual-property laws.
You may view and use the website for legitimate personal or business-information purposes.
You must not copy, reproduce, republish, distribute, commercially exploit or create derivative works from substantial parts of the website without our permission, except where permitted by law.
Third-party names, trademarks or materials remain the property of their respective owners.
Acceptable use
You must not knowingly use this website:
- for unlawful or fraudulent purposes;
- to introduce viruses, malicious code or other harmful technology;
- to attempt unauthorised access to the website, its infrastructure or associated systems;
- to interfere with the security, availability or proper operation of the website;
- to submit deliberately false, abusive or malicious information through website forms; or
- in a way that infringes the rights of Everlight or another person.
Legitimate search-engine indexing and ordinary use of the public website are not prohibited by this section.
Website availability
We aim to keep the website available and functioning properly, but we do not guarantee uninterrupted or error-free access.
We may update, suspend, withdraw or change parts of the website where reasonably necessary, including for maintenance, security, development or business reasons.
Third-party websites and services
This website may contain links to websites or services operated by third parties.
These links may be provided for convenience or information. Unless expressly stated otherwise, Everlight does not control those third-party websites and is not responsible for their content, availability, privacy practices or terms.
A link does not necessarily mean that Everlight endorses the third party.
Our responsibility
Nothing in these Terms of Use excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot legally be excluded or limited.
Subject to the above, Everlight is not responsible for losses arising solely from reliance on general website information where no separate commercial agreement exists between Everlight and the user.
Where Everlight provides services under a separate commercial agreement, liability relating to those services will be governed by the applicable agreement and relevant law.
These Terms do not affect any mandatory legal rights that cannot lawfully be excluded.
Privacy and cookies
Our handling of personal information is explained in our Privacy Policy.
Our use of cookies and similar technologies is explained in our Cookie Policy.
Changes to these terms
We may update these Terms of Use from time to time to reflect changes in the website, Everlight’s business or applicable law.
The latest version will display its update date at the top of this page.
Continued use of the website after an update will be subject to the version then in force.
Governing law
These Terms of Use and any dispute relating to use of this website are governed by the laws of England and Wales.
If you use this website for business purposes, the courts of England and Wales will have jurisdiction over disputes relating to these Terms, subject to any mandatory rights or rules that apply.
Nothing in these Terms removes any mandatory rights available to an individual under applicable law.
